Bill Pryor (my pick–he’s from Mobile, Alabama, what can I say?), Janice Rogers Brown, or Priscilla Owen could easily be nominated. They’ve already been through the wringer with the asshats in the Senate, and they all ended up confirmed (finally!). How would a nomination of one of them possibly be considered “extraordinary circumstances?”
And in light of the recent and loathed Kelo decision, here’s Janice Rogers Brown, in her dissent in San Remo Hotel v. San Francisco:
“Private property, already an endangered species in California, is now entirely extinct in San Francisco,” she observed. The City had become a “neo-feudal regime.” She reprimanded fellow jurists who automatically give a pass to confiscatory land-use restrictions. “Once again a majority of this court has proved that ‘if enough people get together and act in concert, they can take something and not pay for it.’ But theft is theft. Theft is theft even when the government approves of the thievery.”

My choice for the Sypreme Court is (drumroll here) Zell Miller! Why? As the Democrats demonstrated, after Karl Rove discussed liberals, the Democrats became offended, thus proving they can’t differentiate between Liberals and Democrats. Therefore, appointing Zell to the bench will meet with little or no resistance from the Democrats, since he is one, albeit, a conservative one.

Dead-on observation. Any of the three newly-confirmed Justices should, in theory, be given a pass. In theory, anyway. In practice, nope, not gonna happen. The Loony Left will fillibuster till the cows come home if it’s anyone they don’t approve of.
