Charles G. White, a lawyer from Texas and a Vietnam Veteran, writes the following:

“Below is proof that suggests that Kerry received less than an honorable discharge at the completion of his obligation in February 1972. These items are:

1. Link to Kerry’s Discharge issued six years late in 1968 which recites 10 U.S.C. §§ 1162 and 1163 which covers situations of discharges less than honorable and which recites an action before a board of officers under § 1163. This is taken from Kerry’s own web site (PDF).

2. 10 U.S.C. § 1163 as it existed in the 1970’s (since repealed) as in effect from 1956 through 1994 (recited in full below).

3. Sample case of Carter v. Seamans which discusses a less than honorable discharge given to an officer and cites 10 U.S.C. § 1163 (included at the bottom of this message).

As we are aware, the political climate changed and Carter granted amnesty to draft dogers after he came in office.”

In the summer of 1970 John Kerry reportedly met with Madame Binh, the Viet Cong’s chief negotiator in Paris. He subsequently returned to the U.S. to push for Madame Binh’s ‘7-Point Peace Plan’. He made his pitch in Washington. D/C. in July 1971.

Kerry didn’t use the Binh 7-Point Plan as a ‘guideline’ for his recommendations…he used (and implemented it) as an Operations Order…complete with Surrender, Admission of Guilt, Reparations, the whole magilla. [Read: Hanoi's American Puppets?]

Everything Madame Binh instructed Kerry to do, he DID. He did so either as a complicit co-conspirator, or as a ‘useful idiot’…you decide.

We believe that Mr. Bush’s three most important decisions were the right ones. First, he decided to treat Islamic terrorists as a military adversary, rather than as primarily a matter for intelligence and law enforcement.

Second, he finally decided to enforce 13 years of United Nations resolutions by leading a coalition to remove the dangerous Saddam Hussein from power — in so doing, helping eliminate the threat from Libya’s Moammar Gadhafi as well.

Third, he pushed through several well-designed, broad-based tax cuts that gave especially large percentage breaks to lower-income workers — and staved off the worst of what could have been a far more difficult recession.

I was a colonel assigned as Director of Operations of Headquarters, Texas Air National Guard when George W. Bush was a lieutenant in the Air Guard. Since 1999, I have been besieged by the media, from the London Guardian to CBS’s Sixty Minutes, NBC, the Boston Globe, and others, with allegations and questions about Lt. Bush’s service in and discharge from the Texas Air National Guard and USAF. I recently appeared on Fox & Friends twice to shoot down CBS’s phony memos about Lt. Bush and allegations about his discharge. In the interest of fairness and equal time, it is time scrutiny of John Kerry’s discharge(s) is demanded.

A document [PDF] on Kerry’s website is a form letter from W. Graham Claytor, Carter’s Secretary of the Navy, which grants his Honorable Discharge.

Secretary Claytor’s letter says that this action to award an Honorable Discharge Certificate is taken in accordance with Title 10, U.S. Code, Sections 1162 and 1163, which deal with grounds for involuntary separation of a reserve officer and provide for the action of “a board of officers” to examine an officer’s records and review previous actions. Obviously, this was the aforementioned board for appeal resulting from President Carter’s executive order. Unless Lt. Kerry had previously received an undesirable discharge, he had nothing to appeal and would not have come before this board.

DEMOCRAT SUPPRESSING MILITARY VOTES

That rotten sleaze-ball Ed Rendell is working OVERTIME to SUPPRESS MILITARY VOTES!

From the PA GOP:

“Rendell and PA Democrats More Interested In Helping Prisoners Vote Than
Our Military Men and Women, Santorum and Specter fight to allow extension
for Servicemen to have their vote counted.

Ignoring requests for weeks to help families who have loved ones serving
in the military overseas who may be unable to vote in Tuesday`s general
election, Gov. Ed Rendell yesterday offered a half-hearted deal to two
military parents who testified that their son`s ballots were sent late.
The deal will allow the absentee votes coming back from servicemen and
women to be counted up to 8 days after the election. The two parents had
come to the Republican State Committee with their problem after trying to
address the problem with Rendell himself. State Committee offered free
legal service to the two parents, who in turn filed suit earlier this week
against Rendell and asked for a 15 day extension. The two were forced to
agree to Rendell`s “final best offer” while admitting that the time would
probably not be enough for their own son`s votes to count but felt that it
was the best they could get.

Senator Rick Santorum and other Republican lawmakers have been calling on
Rendell over the past two weeks to join them on behalf of soldiers
fighting around the world in extending the deadline in which ballots could
be returned from overseas.

After hearing of reports from parents and soldiers that their sons and
daughters had not yet received their absentee ballots, Santorum and others
called upon Rendell to join the US Department of Justice, who had sued the
state over this matter, and agree to an extension of the deadline.
Unfortunately, Governor Rendell, who fought ardently against allowing
military votes to be counted in the Florida recount in 2000, put
partisanship over principle and fought against extending the deadline here
in Pennsylvania for the 2004 General Election. That position directly
contradicts Gov. Rendell`s actions during the Primary Election, when he
supported such an extension.

Rendell insisted that no credible evidence existed that military men and
women would not have their vote counted. Rendell maintained publicly that
all counties met their obligation to voters at the same time his legal
team, led by Mark Aronchik, admitted in court that they knew of ballots
that were sent late. (Aronchik is a well known Democrat attorney and big
money donor of the Kerry Campaign and is the infamous “Butterfly Ballot”
lawyer of Florida 2000 fame.)”

No, I’m not finished with that TRAITOR.

Well, THIS makes me proud…as I can claim Pascagoula, MS as a hometown of sorts (I went to high school there, and Senator Lott–a friend of the family, but I don’t know him personally–hails from there as well):

While John Kerry is running around claiming President George Bush and our troops overseas failed the American people by not guarding an explosives dump without explosives in it, documents have been uncovered at Texas Tech University that show Kerry was following Vietnam War protest guidelines from North Vietnamese communists in the early 1970s.

“Wait! Why am I not seeing any of this in the national news media, Mr. Gaylon?” you might be asking. “This cannot be true. Our Democrat candidate for president surely wasn’t on the side of the communists and carrying out their requests when he got home from valiantly fighting for his country and winning all those medals, was he?”

Yes, he was.

The documents — which actually LOOK like they came from the 1970s and not from a Microsoft Word program — were found at the Vietnam Center at Texas Tech University in Lubbock and reproduced from captured communist records. These documents have been PROVEN 100 percent authentic BEFORE their release, unlike those 60 Minutes National Guard documents that CBS refuses to investigate. They show that Madame Nguyen Thi Binh, the Viet Cong provisional governor of South Vietnam at the Paris Peace Talks, delivered a plan from Le Duc Tho — Ho Chi Minh’s second in command — for American anti-war activities that anti-war protesters followed to the letter.

These documents are available at www.worldnetdaily.com or www.wintersoldier.com and show anti-war protesters not only received approval from the communists in North Vietnam, but also their direction. One of the documents states, “The spontaneous antiwar movements in the U.S. have received assistance and guidance from the friendly (i.e. communist Vietnamese) delegations at the Paris Peace Talks.”

Another article at www.nysun.com/article/3756 also reflects on the North Vietnamese anti-war coordination with protest groups.

By the way, Madame Binh subsequently became the Minister of Information for the People’s Republic of Vietnam after Saigon fell. You know what “Minister of Information” means in communist countries, right?

Of these organizations, the Vietnam Veterans Against the War and the communist organizations Peoples Committee for Peace and Justice and National Peace Action Committee were represented at the talks. Some representatives of these groups had their airfare covered by the United States Communist Party.

Shortly after Kerry returned from the talks he delivered Madame Binh’s peace proposal through a press conference on July 22, 1971. He did so with veterans’ families around him, a tactic that was suggested by the communists. However, he said he only attended the peace talks because he was on his honeymoon in Paris.

There are two problems, Hanoi John met twice, and possibly thrice, with communist officials in Paris. Also, his honeymoon was spent at the Jamaica home of the Pershing family with then (other) heiress wife, Julia Thorne, in 1970. I suppose Paris was a second honeymoon.

Kerry had also met illegally with Binh in 1970 while he was still a Naval officer on inactive reserve status, and in fact, all his meetings were under the six-year window of the term of his enlistment. This precludes him from even running for elective office, much less president, but nobody is mentioning it for some reason. Amendment 14, Section 3 states: “No person shall be a Senator or Representative in Congress, or elector of President and Vice-president, having previously taken an oath to support the Constitution of the United States, [who has] engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof.”

Other documents show the Hanoi plan for war protests, which was basically accepted and carried out by PCPJ, NPAC and VVAW and other protest groups, which eventually forced a vastly superior military force to capitulate to a sniveling gang of thugs because of propaganda and lies.

It was John Kerry’s finest hour.

The euphoria of the election will quickly fade in the litigious aftermath of the voting discrepancies, real and imaginary, and then the lawsuits contesting John Kerry’s eligibility to be president at all will come. This will begin one of the most heated and contentious legal and political battles in American history. And the blood will be on the hands of the Democratic Party which has nominated and elected a man who appears to have committed treason, to have given aid and comfort to any enemy of the United States in a time of war, to the presidency.

And if Kerry is removed from office, then the Presidency will fall on the shoulders of John Edwards, a one-term senator from South Carolina who would not be re-elected to the Senate if he ran again, a trial lawyer who has made himself rich by suing doctors, a man with no military experience, no international diplomatic experience, no national political experience before this election, a man whom even John Kerry has called unqualified to be president!

And what if this legal challenge to the legitimacy of a Kerry presidency occurs at a time of great danger to the United States? In the midst of a war on terrorism? If it disrupts the ability of the administration to conduct that war? What if the election of such a candidate is, itself, an act of giving aid and comfort to an enemy of the United States?

These are serious questions, and serious issues, about which I see no public discussion, certainly not in the New York Times, the Los Angeles Times, the Washington Post, the San Francisco Chronicle, or on ABC, CBS, CNN, NBC, MSNBC, or even Fox News.

We are on the verge of an election. John Kerry is still covering up some of his own service records, and whatever is in them, and the American people deserve to know what he doesn’t want us to know. Where is the “Peoples’ Right to Know” now? We need to know, before we vote. We don’t like cover-ups. We have called them Watergate. Iran-Contragate. Whitewatergate. Monicagate. They have brought down some presidents, and humbled others. We may call the next one Kerrygate.

And John Kerry and the Democrats will have no one to blame but themselves.

I have been asked by the highest authorities (No — I will not expound) to not hold this Rally.

Although our actions and intent has been nothing but honorable, this effort will not serve our purposes.

My sincerest apologies for this but I must ask that we stand down…

I certainly hope the “highest authorities” know what they are doing and I don’t like this anymore than anyone else but I must ask you to stand down.

We can however, return to our previous effort in getting the truth to media outlets, Congress, and other influential organizations.

This was a great idea and I’m very disappointed — I hope you will forgive me for this. I’m assured that all will be clear in time (yeah right).

GOT THAT? OTHER THAN HONORABLE DISCHARGE.

[SECNAVINST 1910.4B defines these terms as follows:]

c. Other Than Honorable (OTH): A characterization of other than honorable is appropriate when the reason for separation is based upon one or more acts that constitute a significant departure from the conduct expected from members of the naval service. Persons given an OTH discharge are not entitled to retain their uniforms, must accept transportation in kind to their homes, are subject to recoupment of any reenlistment bonus they may have received, and do not receive mileage fees from the place of discharge to their home of record. Additionally, the Veterans Administration will make its own determination whether the discharge was under conditions other than honorable. This characterization is authorized only if the service member has been afforded the opportunity to request an Administrative Board, except as provide by Separation in Lieu of Trial by Court-Martial.

REGULATION GOVERNING THE DD214 SAYS:

3.4.9. The following are the only authorized entries in Block 24, Character of Service, as appropriate: “Honorable,” “Under Honorable Conditions (General),” “Under Other Than Honorable Conditions,” “Bad Conduct,” “Dishonorable,” or “Uncharacterized.” When a discharge has been upgraded, the DD Form 214 will be annotated on copies 2 through 8 in Block 18 to indicate the character of service has been upgraded; the date the application for upgrade was made; and the effective date of the corrective action.

MORE research done:

Among Kerry’s released records is a 1977 cover letter from Jimmy Carter’s Navy Secretary, W. Graham Claytor. What is revealing about this document is that it notes Kerry’s original discharge was subject to review by a “board of officers” — yet no such review should be necessary for an Honorable Discharge.
The review was conducted in accordance with “Title 10, U.S. Code Section 1162 and 1163,” which pertains to grounds for involuntary separation from military service. As many Vietnam veterans who served their nation with dignity and honor will recall, Jimmy Carter’s first official act as president was the signing of Executive Order 4483 –less than an hour after his inauguration on 21 January 1977. EO 4483 provided general amnesty for draft evaders, war protesters and other offenders of that era. Its corresponding, and equally dubious, DoD directive took effect in March of 1977, expanding that amnesty to include separation from military service by other than honorable discharges. The DoD specified an appeal procedure whereby discharges could be reviewed on an individual basis to determine whether the status of a particular discharge could be revised.
